At De Chiara & Finkelberg Legal Services, we are dedicated to helping individuals and businesses achieve fair and efficient justice through the Small Claims Court. This court deals with civil disputes involving claims up to $50,000, providing a straightforward and cost-effective way to resolve issues such as unpaid debts, contract disputes, and property damage.
Human rights Law and Employment Law
Human Rights are issues that revolve around issues related to discrimination and harassment, conflicting with the Human Rights Code. The Human Rights Tribunal of Ontario (HRTO) is the body that oversees applications filed, alleging discrimination on the basis of one of the 16 prohibited grounds. These grounds include: Age, Ancestry, Colour, Creed, Disability, Ethnic Origin, Family Status, Gender Identity, Gender Expression, Marital Status, Place of Origin, Race, Record of Offences (Employment), Receipt of Public Assistance (Housing), Sex, and Sexual Orientation.
Here at De Chiara & Finkelberg, we represent clients who have experienced a violation on the basis of any of their legally protected grounds, as well as guiding them through the HRTO hearing process. Human rights disputes are complicated matters; we cannot guarantee a desirable outcome. However, we can guarantee our dedication to your case. We are here to fulfil your needs, so please feel free to contact us for a free 45-minute consultation!
Employment Law: Here at De Chiara & Finkelberg, we represent both employers and employees in regards to employment disputes.
For Employers: We adjudicate issues related to employment contracts, termination with or without just cause, and regulatory offences including workplace safety violations. We also manage relations with workers' unions and legal disputes with individual employees.
For Employees: We adjudicate cases involving issues such as wrongful dismissal, constructive dismissal, workplace harassment, workplace injury claims and insurance claims, and workplace safety-related issues. We can also work to resolve individual claims related to contractual disputes, or issues involving termination, severance, or entitlement rights. Workplaces can be tough to navigate for both the employer and employees. Our goal is to help our clients understand and know their rights, and to keep them protected at every turn. We guarantee steadfast dedication to all our clients, regardless of the scenario.
Employment law governs the relationship between employers and employees, which involve a variety of unique legal rights, responsibilities and minimum standards. Employment law protects and creates fair treatment, safe working conditions, and prevents regulatory violations in the workplace.
Landlord and tenant Law
In legal matters involving the LTB (The Landlord and Tenant Board), we can help to adjudicate issues which might concern either tenants or landlords. Such legal matters may involve disputes pertaining to leasing agreements or payment of rent, eviction-related conflicts, and other issues involving tenants’ or landlord’s legal rights, or matters involving safety, independence, or quality of life for individuals or the community. The disputes adjudicated through the LTB can also involve facilities upgrades, construction, temporary relocations, or regulatory violations. We will strive to protect our clients’ individual rights and freedoms, while also protecting the harmony of the larger community.
provincial offences
Provincial offences are those often referred to as “quasi-criminal” or regulatory offences. The Canadian Parliament affords each province the right to create regulatory laws within their jurisdictions. In Ontario, such offences are commonly known as things like speeding, or holding a cellphone, under the HTA (The Highway Traffic Act). Laws which govern environmental protection, construction permits, pet ownership, trespassing on private property, or noise ordinances, are other examples of such regulatory guidelines. Provincial offences courts permit adjudication of violations of such rules by generating standardized punishments or fines which are suited to each case. Motor vehicle collisions, another component of this area, should be handled with precision and sensitivity. We strive to protect individuals’ rights while balancing a need for protecting communal safety.
